Terms of Service

These terms are an agreement between you and Varsity Go (“Varsity Go”, “we”, “us”). They apply when you use the Varsity Go passenger app, the Varsity Go Rider app or this website. Please read them with our Privacy Policy. By creating an account you accept these terms.

1. What Varsity Go is

Varsity Go is a technology platform that connects passengers with independent motorcycle riders (“riders”) around Maseno, Kisumu County. Riders are not our employees. They decide when to go online and which requests to accept, and they are responsible for the ride itself. We provide the apps, set prices, take payments, pay riders, check riders before they can accept trips, and run safety and support services.

2. Your account

  • You must be at least 18 years old and able to enter into a binding contract under Kenyan law.
  • You sign in with a Kenyan mobile number and a one-time code. Keep your phone secure: anyone who can read your SMS can sign in as you.
  • Give us accurate information, and use your real name so your rider or passenger knows who to expect.
  • One person, one account per app. Accounts can’t be shared, sold or transferred.

3. Booking and prices

  • Before you book, the app shows the fare (paid to the rider), the Varsity Go fee (added on top) and the total. Once you request a ride with a valid quote, that total is the price for the trip. It doesn’t change for traffic or the route the rider takes.
  • Quotes are valid for a few minutes. If one expires, the app gets a new one and shows it to you before you book.
  • We only operate inside the service area shown in the app. Requests to or from places outside it can’t be booked.
  • After you request, we offer the trip to nearby available riders. We can’t promise a rider will be available. If nobody accepts within the search time, the request ends and you are not charged.

4. Payment

  • Trips are paid through M-Pesa, processed for us by our payment provider. When a rider accepts, you receive an M-Pesa prompt for the amount due. Your Varsity Go wallet balance, if any, is used first. If the payment doesn’t go through after the attempts shown in the app, the trip is cancelled and nothing is charged.
  • The rider sets off only after payment is confirmed. Don’t pay riders in cash or to a personal number for a Varsity Go trip.
  • Your wallet holds refunds and credits for future rides. It is not a bank account or e-money account and earns no interest. Wallet credit can be used for rides. When you delete your account, any balance is refunded to your M-Pesa number.

5. Cancellations and refunds

  • You can cancel at any time before the trip starts. Cancelling is free until the rider is close to your pickup. After that, a cancellation fee is paid to the rider for their time. The app shows whether a fee applies, and how much, before you confirm. The fee is never more than the fare.
  • If your rider cancels, or our team cancels a trip, you are refunded in full.
  • Refunds go to your wallet immediately by default. If you choose M-Pesa instead, the refund is sent to your M-Pesa number in a later daily payout run, after a review by our finance team.
  • If you were charged for a trip that did not happen, or charged twice, contact support with the M-Pesa receipt number. We check our records against the payment provider’s and refund any amount we owe.

6. Safety

  • Show your trip PIN only to the rider who arrives on the bike shown in your app, and check the plate before you get on.
  • Both rider and passenger must wear a helmet and follow the Traffic Act and its rules for motorcycles. A rider may refuse to start a trip that would be unsafe or unlawful.
  • The SOS feature alerts our team and your trusted contacts. It is not an emergency service. In an emergency, call 999 first. We aim to respond to every SOS quickly, but we can’t guarantee a response time.

7. Additional terms for riders

  • To ride you must pass our checks and keep, for as long as you use the Rider app: a valid national ID, a valid driving licence that covers motorcycles, a roadworthy motorcycle registered under the plate you gave us, and any licence, permit and insurance Kenyan law requires to carry paying passengers. You must tell us straight away if any of these lapse.
  • Only you may ride on your account, on the bike you registered. Lending your account to anyone else leads to permanent removal.
  • Earnings. You keep the full fare of each completed trip, and any cancellation fee paid to you. The Varsity Go fee is charged to the passenger and is not deducted from your earnings.
  • Payouts. Earnings are paid once a day to the M-Pesa payout channel we register with you, after our finance team approves the day’s batch. Amounts below the minimum payout shown in the app roll over to the next payout. We may hold a payout while we investigate suspected fraud or a serious safety report, and we will tell you why.
  • Collect payment only through the app. Don’t ask passengers for extra money, take trips off the app with passengers you met through it, or start a trip without the passenger’s PIN.
  • You are responsible for any taxes on your earnings. You use your own bike, phone and data at your own cost.

8. Acceptable use

You agree not to:

  • harass, threaten, discriminate against or harm anyone, or damage their property;
  • make false bookings, false SOS alerts, false reports or fraudulent payment claims;
  • ride, or ask a rider to ride, under the influence of alcohol or drugs, or carry more passengers than the law allows;
  • copy, reverse-engineer, scrape or interfere with the apps or our systems, or use them for anything unlawful.

9. Suspension and closing accounts

We may suspend or close an account that breaks these terms, puts others at risk or is used fraudulently. A person on our team makes that decision, not an automated system, and we will tell you the reason unless the law or an investigation prevents it. You can close your account at any time in the app. Closing it doesn’t cancel amounts already owed either way.

10. Our responsibility to you

Nothing in these terms limits rights you have under the Consumer Protection Act, 2012 or other Kenyan law that can’t be excluded by contract. Subject to that:

  • we provide the apps with reasonable skill and care, but we can’t guarantee they will always be available, error-free or that a rider will be available;
  • we are not liable for losses caused by the acts or omissions of riders or passengers, or by events outside our reasonable control, such as network outages, payment network downtime, weather or road closures;
  • where we are liable, our total liability for a trip is limited to the total amount paid for that trip, except for death or personal injury caused by our negligence, or fraud, where no limit applies.

11. Changes to these terms

We may update these terms as the service changes. If a change matters to you, we will show it in the app at least 14 days before it applies, unless it is needed sooner for safety or legal reasons. If you keep using Varsity Go after a change applies, you accept the new terms.

12. Law and disputes

These terms are governed by the laws of Kenya. If you have a complaint, contact support first. We’ll try to resolve it within 14 days. If we can’t, either of us may take the dispute to the courts of Kenya.
